Maskara is provided for entertainment and emotional expression purposes only. Features such as "Listener" sessions, Gabi Mode, and community interactions are not professional counseling, therapy, or crisis intervention services. Any resemblance to such services is incidental and should not be relied upon as a substitute for professional care.
Maskara is built around anonymous expression. With that freedom comes responsibility. You agree not to use the platform to:

If a user's content suggests they may be in crisis, Maskara may, at its discretion, surface information about third-party crisis resources. Maskara has no duty to monitor user content for signs of crisis, no obligation to detect or intervene in any user's situation, and is not responsible for any outcome related to content posted, viewed, or exchanged on the platform. Any redirection to external resources is provided as a courtesy only, with no guarantee of accuracy, availability, or response, and does not create any duty of care between Maskara, HirayaX, and any user.
Maskara is not obligated to monitor, review, or screen user content before or after it is posted. While we may remove content or restrict access at our discretion (see Section 4), we make no guarantee that all violating, offensive, or harmful content will be detected or removed in a timely manner, or at all. Users interact with content posted by others at their own risk.
You retain ownership of the content you post. By posting, you grant Maskara a non-exclusive, worldwide license to display, distribute, and (where applicable, such as the Share Card feature) format your content for use within the platform's intended features.
Maskara may offer optional paid features (such as Gold tier membership or gifting). These are entertainment add-ons and do not entitle users to any professional service, guarantee of outcomes, or refund beyond what is stated at time of purchase.
Maskara is provided "as is" and "as available," without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee the platform will be uninterrupted, secure, error-free, or free of harmful content posted by other users.
To the fullest extent permitted by law, HirayaX and its affiliates, officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of, or inability to use, Maskara — including but not limited to emotional distress, loss of data, loss of goodwill, or reliance on user-generated content — even if advised of the possibility of such damages. Where liability cannot be fully excluded under applicable law, our total liability to you for any claim arising from your use of Maskara shall not exceed the greater of (a) the amount you paid us, if any, in the twelve months preceding the claim, or (b) one hundred Canadian dollars (CAD $100).
You agree to indemnify, defend, and hold harmless HirayaX, Maskara, and their affiliates, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with: (a) your access to or use of Maskara; (b) content you post, submit, or transmit through the platform; (c) your violation of these Terms; or (d) your violation of any rights of another person or entity, including defamation, harassment, or infringement claims arising from your conduct.
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles. Any dispute arising out of or relating to these Terms or your use of Maskara shall first be attempted to be resolved through good-faith informal negotiation. If unresolved within thirty (30) days, the dispute shall be submitted to binding arbitration administered under the rules of a recognized arbitration body in Ontario, Canada, rather than litigated in court, except that either party may seek injunctive relief in a court of competent jurisdiction where necessary to prevent irreparable harm. You agree to bring any claim on an individual basis only, and waive any right to participate in a class action.
Maskara does not require account registration and does not collect personally identifying information in the ordinary course of use. As such, enforcement actions under these Terms are applied against technical identifiers associated with a user's activity — including, without limitation, session tokens, IP addresses, device fingerprints, and other connection metadata — rather than against a named individual or registered account.
We reserve the right, at our sole discretion and without prior notice, to: (a) remove, hide, or restrict the visibility of any content; (b) block or restrict access from specific IP addresses, network ranges, session tokens, or device identifiers; and (c) implement automated or manual technical measures to detect and limit repeat or severe violations of these Terms.
Due to the anonymous and stateless nature of the platform, you acknowledge and agree that such enforcement measures may not result in the permanent or guaranteed exclusion of any individual, and that a user may be able to circumvent a technical restriction through the use of a new session, device, network, or other means. Maskara makes no representation or warranty as to the completeness or permanence of any enforcement action, and shall not be liable for a user's continued access to the platform following an attempted restriction.
Maskara is operated under HirayaX. These terms do not constitute a partnership, employment, or agency relationship between you and HirayaX.
We may revise these terms from time to time. Continued use of Maskara after changes are posted constitutes acceptance of the revised terms.
